Terms of Service

Welcome to Immortal Tiger!
These Terms of Service ("Terms") govern your access to and use of the Immortal Tiger mobile application (the "App"), provided by Shinavoka Studio, operated by an individual developer in Vietnam ("we," "us," or "our"). By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the App.
1. A Note on the Nature of the Project & Associated Risks
Immortal Tiger is a passion project developed and operated by a single individual. We are committed to creating an exciting and engaging experience. However, due to the nature of a solo operation, we want to be transparent about certain realities and risks:
- Resource Limitations: As a one-person project, resources (including time and finances) are limited. This may lead to slower development updates or periods of server downtime for maintenance or unforeseen issues. We ask for your patience and understanding.
- Project Continuity & Service Discontinuation: While we are dedicated to the long-term success of Immortal Tiger, the continuation of the game is dependent on its financial viability. In the unfortunate event that the project is no longer financially sustainable, we reserve the right to cease development and discontinue the service. We will strive to provide at least 30 days' notice to our users via in-app announcements or email before discontinuing the service.
- Refunds and Service Discontinuation: Refunds for in-app purchases and subscriptions are handled exclusively by the platform through which the purchase was made (e.g., Google Play or Apple App Store) and are subject to their respective refund policies. In the event of service discontinuation, any potential refunds for active subscriptions will be processed in accordance with the terms and conditions of the respective platform.
By using this App, you acknowledge and accept these risks. We deeply appreciate your understanding and support as we build this world together.
2. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.
Age Verification (Effective January 1, 2026):
We use Google Play Age Signals API to verify user age and comply with laws in Texas, Utah, Louisiana, Brazil, and other jurisdictions.
Users Under 18: You must have parental approval through Google Family Link. Parents can manage access, approve purchases, and revoke approval at any time. See our Privacy Policy for details.
Users under 18 should obtain parental or guardian consent before using communication features such as in-game chat. Age-appropriate content filtering and feature restrictions are automatically applied based on your age.
Brazil Users — Digital ECA (Effective March 17, 2026):
If you are located in Brazil and are under 18, additional protections apply under Brazil's Digital Statute of the Child and Adolescent (ECA Digital — Lei n° 15.211/2025).
- ✔ Chat and player interaction features for younger users may be disabled by default and may require parental consent via Google Family Link, in accordance with Article 21.
- ✔ Randomized reward mechanics (loot boxes) are not available to users identified as minors (Article 20).
- ✔ No targeted advertising based on profiling will be applied to minors (Article 22).
- ✔ The most privacy-protective settings are applied by default (Articles 16–18).
3. User Account
- Registration: To access certain features, you must create an account using a valid email address and password. Providing accurate and complete information is required.
- Account Security: You are responsible for maintaining the confidentiality of your login credentials and any activities under your account.
- Temporary Accounts: If you use a temporary account that is not linked to an email, deleting the App may result in permanent loss of access to your account and data.
4. Personal Information Collection
Our practices regarding the collection and use of personal information are detailed in our Privacy Policy. By using the App, you agree to the collection and use of information as described therein. We collect the following information:
- Email address (for registration, login, and password recovery purposes).
- Age (to verify eligibility through Google Play Age Signals API).
- Hashed unique device identifier (for frictionless login).
- Character names (visible to other players within the game).
- Chat messages (stored temporarily only during active game sessions and automatically deleted upon logout).
- Technical logs and gameplay telemetry (used for security monitoring, anti-cheat detection, abuse investigation, and service stability).
Note: Age verification data from Google Play Age Signals (age category, parental approval status, install ID for supervised users) is used exclusively for compliance and content filtering, never for advertising or analytics. See Privacy Policy for details.
5. Digital Analytics and Advertising
Analytics: We use Firebase Analytics to measure and improve app performance. Age verification data is never sent to analytics services.
Advertising: Ads are displayed through AdMob. Your use of the App constitutes consent to view advertisements. Users under 18 will not receive personalized or behavioral advertising to comply with child protection laws.
6. In-App Purchases (IAPs)
Types of IAPs: The App offers one-time purchases and recurring payments for premium features.
Refunds: Refunds are subject to the policies of the platform through which the purchase was made (e.g., Google Play or Apple App Store).
Parental Approval: All in-app purchases by users under 18 require parental approval through Google Play. Parents will receive notifications for each purchase request and can approve or deny them.
6.1 Virtual Items
Virtual items, in-game currencies, characters, and other digital assets obtained through gameplay or purchases are licensed to you and remain the property of Shinavoka Studio. These items have no real-world monetary value and may not be exchanged for real currency outside of the App. You do not acquire ownership rights to any virtual items or in-game content.
7. User-Generated Content (UGC)
7.1 Acceptance of Terms for User-Generated Content
Before creating a character name or using in-game chat features, you must explicitly accept these Terms of Service and our Community Guidelines. By creating user-generated content, you acknowledge that you have read, understood, and agree to comply with all applicable rules and policies.
7.2 Character Names
You may create custom character names that will be visible to other players. When creating a character name, you agree that your character name will NOT:
- Contain profanity, vulgar, obscene, or sexually explicit language.
- Be offensive, discriminatory, racist, hateful, or promote violence.
- Impersonate other players, staff members, or public figures.
- Infringe on trademarks, copyrights, or intellectual property rights of others.
- Contain personal information (such as real names, phone numbers, or addresses).
- Violate any applicable laws or regulations.
Character names are subject to automated profanity filters and manual review. We reserve the right to reject, modify, or remove any character name that violates these Terms without prior notice. Repeated violations may result in account suspension or termination.
7.3 In-Game Chat
The App provides real-time, session-based text chat functionality. Important: We do not maintain permanent chat history. When you close the game, all chat conversations are permanently deleted and cannot be recovered.
By using the chat feature, you agree to the following:
- No Message History: Chat messages are not permanently stored and are deleted after the session ends. We do not maintain chat logs or conversation history.
- Prohibited Content: You will not post, share, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, hateful, or racially or ethnically offensive.
- Personal Information: You will not share personal information about yourself or others, including but not limited to real names, addresses, phone numbers, email addresses, social media accounts, or financial information.
- Spam and Advertising: You will not post repetitive messages, spam, or unsolicited advertising or promotional content.
- Impersonation: You will not impersonate other players, moderators, staff members, or any other individuals or entities.
- Respect: You will treat other players with respect and refrain from bullying, harassment, or any form of toxic behavior.
- Brazil (Digital ECA): For users under 18 in Brazil, chat and interaction features may be restricted by default for younger users in compliance with applicable child protection laws including Article 21 of the Digital ECA. Parental consent via Google Family Link may be required to enable these features.
Content Monitoring: We use real-time automated filters to detect and block inappropriate content before it is delivered. For safety purposes, messages may be temporarily scanned by automated systems but are not accessible to staff and are automatically deleted within 24 hours. Reported messages are retained only for investigation purposes (up to 7 days) and then permanently deleted.
7.4 License to User-Generated Content
By creating user-generated content (including character names and chat messages), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purposes of operating, maintaining, and improving the App, and enforcing these Terms.
7.5 Reporting and Blocking
The App provides tools to help maintain a safe community:
- Report System: You can report inappropriate character names, chat messages, or user behavior through the in-app reporting system. Please provide as much detail as possible when submitting a report.
- Block Function: You can block other users to prevent them from contacting you via chat. Blocked users will not be able to send you messages or see your online status.
- Review Process: All reports are reviewed by our moderation team. We aim to respond to reports within 48-72 hours. Urgent safety concerns are prioritized.
8. Community Guidelines and Code of Conduct
All users must adhere to our Community Guidelines when interacting with other players. These guidelines are designed to foster a positive, respectful, and inclusive gaming environment. Key principles include:
- Respect Others: Treat all players with kindness and respect, regardless of their skill level, background, or identity.
- No Harassment or Bullying: Do not engage in harassment, bullying, stalking, or any behavior that makes others feel unsafe or unwelcome.
- No Hate Speech: Do not use language or share content that promotes hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
- No Cheating or Exploits: Do not use cheats, hacks, exploits, or any unauthorized third-party software.
- Fair Play: Play fairly and do not attempt to manipulate game mechanics or exploit bugs for personal gain.
- Constructive Communication: Provide constructive feedback and communicate in a positive manner.
9. Content Moderation and Enforcement
9.1 Moderation Tools
We employ a combination of automated systems and manual review to moderate user-generated content:
- Automated Filters: AI-powered filters and keyword blacklists automatically detect and block inappropriate content in character names and chat messages in real-time.
- Manual Review: Our moderation team manually reviews reported content and flagged violations.
- User Reports: Community members can report violations through the in-app reporting system.
9.2 Enforcement Actions
Violations of these Terms, Community Guidelines, or acceptable use policies may result in the following enforcement actions:
- Warning: A formal warning for first-time or minor violations.
- Content Removal: Removal of character names or chat messages that violate our policies.
- Temporary Suspension: Temporary restriction of access to the App or specific features (such as chat) for a specified period.
- Permanent Ban: Permanent termination of account access for severe or repeated violations.
- Legal Action: In cases involving illegal activity, we may report violations to law enforcement authorities.
The severity of enforcement actions depends on the nature and frequency of violations. We reserve the right to take immediate action without prior warning in cases of severe violations.
9.3 Appeals
If you believe an enforcement action was taken in error, you may submit an appeal by contacting us at [email protected]. Please include your account information and a detailed explanation of why you believe the action should be reconsidered. We will review appeals on a case-by-case basis.
10. Prohibited Activities
You agree not to:
- Violate any applicable laws or regulations.
- Interfere with the App's functionality, including using cheats, exploits, bots, or any third-party software to modify the game experience.
- Attempt to hack, decompile, reverse-engineer, or compromise the App's security and data.
- Engage in harassment, hate speech, bullying, or any toxic behavior towards other players.
- Impersonate staff or other players.
- Create or use character names that violate Section 7.2 of these Terms.
- Share prohibited content in chat as defined in Section 7.3 of these Terms.
- Attempt to circumvent automated moderation filters or content restrictions.
- Share, sell, trade, or transfer accounts to other users.
- Engage in real-money trading (RMT) of in-game items, currency, or accounts outside of official channels.
11. Intellectual Property Rights
All content and assets within the App, including but not limited to graphics, logos, text, and game mechanics, are the exclusive property of Shinavoka Studio and are protected by international copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.
12. Communications
We may send emails to your registered email address for password recovery or important account updates. By using the App, you consent to receive these communications.
13. Game Updates and Maintenance
- Game Balancing: The game is regularly updated to adjust gameplay elements and balance character or item statistics.
- Maintenance and Downtime: The App may undergo maintenance or experience technical issues, including errors, server overloads, or interruptions. We strive to minimize disruptions but cannot guarantee uninterrupted access.
13.1 Game Balance and Economy
We may modify, rebalance, adjust, or remove in-game items, currencies, abilities, characters, or gameplay systems at any time as part of ongoing game development and balancing. Such changes may affect the value, availability, or functionality of virtual items and gameplay progress.
13.2 Data Corrections and Rollbacks
In the event of technical issues, exploits, bugs, or service disruptions, we reserve the right to correct, modify, or roll back game data, including player progress, virtual items, or in-game currency, to maintain the integrity and stability of the game environment.
13.3 No Guarantee of Item Availability
We do not guarantee the continued availability of any specific virtual item, feature, or gameplay element. In-game content may be modified, removed, or discontinued at any time.
14. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free, secure, or uninterrupted. We are not responsible for user-generated content created by other players.
15. Limitation of Liability
We are not liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to data loss, interruption of service, or exposure to user-generated content created by other players. Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you have paid to us in the past 12 months.
16. Indemnification
You agree to indemnify and hold harmless Shinavoka Studio and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, your use of the App, or your user-generated content.
17. Termination
We reserve the right to suspend or terminate your access to the App at any time for any violation of these Terms or any applicable laws. Upon termination, your right to use the App will immediately cease, and we may delete your account and associated data in accordance with our Privacy Policy. You may also terminate your account at any time through the in-app account deletion feature.
18. Changes to These Terms
We may update these Terms from time to time. Any changes will be communicated through the App or via email. Your continued use of the App after changes are made constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically. For users under 18, parents may be notified of material changes through Google Play.
19. Governing Law and Dispute Resolution
These Terms are governed by the laws of Vietnam. Any disputes arising from these Terms or your use of the App will, in the first instance, be attempted to be resolved through direct communication with our support team. If a resolution cannot be reached, the dispute will be resolved exclusively in the courts of Vietnam.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
21. Compliance with Age Verification Laws
These Terms, together with our Privacy Policy and use of Google Play Age Signals API, are designed to comply with age verification and parental consent laws including Texas SB2420, Utah HB311, Louisiana Act 440, COPPA, GDPR, and Brazil's Digital ECA (Lei n° 15.211/2025). We continuously monitor legal requirements and update our practices accordingly.
21.1 Brazil's Digital ECA (Lei nº 15.211/2025)
In compliance with Brazil's Digital Statute of the Child and Adolescent (Lei nº 15.211/2025), effective March 17, 2026, we implement the following safeguards for users identified as minors in Brazil:
- Article 21 — User Interaction: Interactive features such as chat or direct player communication may be restricted by default for users identified as minors and may require parental consent before being enabled.
- Article 20 — Randomized Rewards: Randomized reward mechanics (commonly known as loot boxes or gacha systems) are not offered to users identified as minors.
- Article 22 — Advertising Protections: We do not engage in behavioral profiling, targeted advertising, or manipulative advertising practices directed at minors.
- Articles 16–18 — Privacy and Safety by Default: Privacy-protective settings, including limited social interaction and reduced data collection, are applied by default for accounts identified as belonging to minors.
- Article 12 — Age Assurance: Age assurance is performed using platform-provided signals such as Google Play Age Signals without requiring additional documentation from users.
Oversight of the Digital ECA is conducted by Brazil's National Data Protection Authority (ANPD). We monitor official guidance issued by the ANPD and update our practices as necessary.
